Can Florida Homeowners Trim, Prune Or Remove Trees Without A Tree Removal Permit?

Here are the details. In 2019, House Bill 1159 made it possible. Sponsored by State Representative Mike La Rosa, it was also known as the “private property rights” bill. It allows homeowners to trim, prune or remove trees without having to obtain a permit or application from a local government. In addition, local governments are prohibited from requiring notice, application, approval, permit, fee or mitigation for the pruning, trimming or removal of a tree on residential property if the owner obtains documentation, from a certified arborist of the International Society of Arboriculture or a Florida licensed landscape architect, that the tree presents a danger to persons or property.

You may wonder if you can cut down trees on your property. Perhaps you have heard that you need a permit to even trim trees. So what should you do?

FACT: Not All Tree Removals Needs a Tree Removal Permit

The State of Florida Statute Says:

163.045 Tree pruning, trimming, or removal on residential property.

(1) A local government may not require a notice, application, approval, permit, fee, or mitigation for the pruning, trimming, or removal of a tree on residential property if the property owner obtains documentation from an arborist certified by the International Society of Arboriculture or a Florida licensed landscape architect that the tree presents a danger to persons or property.

(2) A local government may not require a property owner to replant a tree that was pruned, trimmed, or removed in accordance with this section.

(3) This section does not apply to the exercise of specifically delegated authority for mangrove protection pursuant to ss. 403.9321403.9333.

For trees located on your own property, permits are not required for trimming or pruning. All tree pruning shall be conducted according to National Arborist Association standards.
